Terms of Service

Scope and Parties of the General Terms and Conditions

A) Scope

These Terms and Conditions govern the services available on the Website, the use of the Website, and the sale and purchase of products offered through the online store operated on the Website.

B) Contracting Parties

The parties to the contract are:

The Service Provider, identified above, acting as the operator of the Website, seller of the products, and provider of the services.

The User, acting as a purchaser of products ordered through the online store and as a visitor to the Website.

Any natural person, legal entity, or business organization without legal personality, including foreign legal entities, may become a User, provided that they accept and acknowledge these Terms and Conditions as binding upon themselves.

Contracts concluded under these Terms and Conditions may be entered into by persons lacking legal capacity or having limited legal capacity only in accordance with the applicable national laws.

C) Effective Date

These Terms and Conditions become effective upon publication on the Website and remain valid for an indefinite period.

General Information on Distance Contracts Concluded Electronically

A)

Prior to placing an order, the User may obtain information about the essential characteristics of the products and services from the relevant product and service description pages available on the Website.

B) Language of the Contract

The language of the contract shall be the official language of the respective country.

Examples:

  • Hungary: Hungarian

  • Slovakia: Slovak

  • Germany: German

C)

Orders placed through the Website constitute legally binding declarations of intent made by implied conduct.

D)

The Service Provider shall confirm receipt of the order electronically without undue delay.

If the confirmation is not received by the User within forty-eight (48) hours of submitting the order, the User shall no longer be bound by their offer.

E)

The concluded contract shall not be considered a written contract. It will not be registered by the Service Provider and will not be available in written form at a later date.

F)

The Service Provider has not adopted any code of conduct.

G)

Before submitting an order, the User will be informed of the applicable shipping fees, any delivery restrictions, and the available payment methods.

H)

The Terms and Conditions and all legally required information documents applicable at the time of the order shall be provided to the User as attachments to the order confirmation sent by e-mail.

In addition, the User may download, save, or print these Terms and Conditions and related information documents from the Website at any time, where they remain continuously available in their current version.

Registration

A)

Registration is free of charge.

B)

Registration may be completed by clicking the “Registration” button on the Website, completing the registration form, accepting these Terms and Conditions, confirming acknowledgment of the Privacy Policy, and clicking the “Registration” button again.

C)

To create a valid registration, the User must provide accurate and truthful information and contact details.

If it is determined that the registration was completed using false information, the Service Provider reserves the right to delete the registration. The Service Provider shall not be liable for any consequences resulting from such deletion.

D)

The Service Provider may also delete a valid registration without liability for any resulting consequences if the User has used the Website in bad faith or has otherwise violated these Terms and Conditions.

E)

Deletion of a registration for the reasons stated above shall not affect orders that have already been fully performed by both parties.

If performance of an order has not yet commenced, the Service Provider may decide at its sole discretion whether to fulfil the order, provided that the reason for deletion does not prevent performance.

If the Service Provider decides not to fulfil an already paid order, the amount paid by the User shall be refunded.

If the conduct that led to the deletion of the User's registration caused damage to the Service Provider, the Service Provider shall be entitled to deduct the amount of such damage from the refund.

F)

The User may request deletion of their registration at any time by sending an e-mail to the Service Provider.

The Service Provider shall delete the registration without undue delay and no later than ten (10) calendar days after receipt of the request.

G)

Deletion of the registration may also become necessary if the User requests deletion of the personal data processed for registration purposes or objects to further processing of such data.

H)

Deletion of a registration at the User's request shall not affect the fulfilment of orders that were validly placed prior to deletion.

Determination of the Purchase Price

A)

The User may obtain information regarding the current prices of products and services on the relevant product and service pages of the online store.

B)

The prices displayed for products and services are gross consumer prices, meaning that the total amount payable, including all applicable taxes and value-added tax (VAT), is shown.

C)

Prices are always expressed in the currency indicated next to the price.

D)

Prices do not include shipping costs.

E)

The Service Provider does not charge any packaging fee.

F)

Order confirmations always contain the actual gross consumer price payable as well as any additional charges in their full payable amount.

G)

The Service Provider reserves the right to modify the prices displayed on the online store at any time.

Price changes shall not affect products or services that have already been ordered.

H)

If an incorrect price is displayed in the online store or in an order confirmation, particularly in the case of an obviously erroneous price, the Service Provider shall not be obliged to sell the product or service at the incorrect price.

Following discovery of the pricing error, the Service Provider shall offer the User the opportunity to purchase the product or service at the correct price.

If the User does not accept the corrected price, the User shall be entitled to cancel the order.

Ordering Process and Formation of the Contract

A) Product Selection

The User may review the essential characteristics of the products on the respective product pages of the online store.

By clicking the “Add to Cart” button on the product page, the User may place the selected product into a virtual shopping cart.

If the User wishes to order multiple products, additional products may be added to the cart in the same manner.

Should the User have any questions regarding a product prior to placing an order, the Service Provider's customer service team is available to assist (contact details are provided under the “Customer Service” section).

B) Placing an Order, Order Confirmation and Formation of the Contract

Orders may be placed online through the online store.

Registration is not required to place an order.

After selecting products and adding them to the shopping cart, the User may review the cart contents by clicking the “Cart” button. The cart displays the selected products, quantities, and total purchase price.

The User may modify quantities or remove products from the cart prior to submitting the order.

The User must then select the preferred shipping method and payment method.

The following information must be provided:

  • Full name

  • E-mail address

  • Telephone number

  • Billing address

Correction of Data Entry Errors

The Website provides tools that allow Users to identify and correct data entry errors before submitting their contractual declaration.

These include:

  • Warning messages displayed when mandatory information is missing or obviously incorrect.

  • The ability for registered Users to modify personal information during the ordering process.

  • The ability to update registration details within the User account.

  • The ability to review, modify, or delete any order information before final submission.

The User may return to previous steps using the browser’s back function or the order process navigation displayed on the Website.

After reviewing all information and correcting any errors, the User may submit the order by accepting these Terms and Conditions and clicking the “Submit Order” button.

The Service Provider shall automatically acknowledge receipt of the order by e-mail without undue delay.

The acknowledgement contains the total amount payable by the User or, in the case of online payment, the amount already paid.

If the acknowledgement is not received within forty-eight (48) hours of submission, the User shall no longer be bound by the offer.

An acknowledgement shall be deemed received when it becomes accessible to the User, including upon arrival in the User’s e-mail inbox.

The automatic acknowledgement of receipt does not constitute acceptance of the order and does not create a purchase contract.

Orders are processed during the business hours published on the Website.

Orders received outside processing hours shall be deemed received at the beginning of the next processing period. In the case of advance payment, processing begins after payment has been credited to the Service Provider's bank account.

Following the commencement of processing, the Service Provider shall notify the User by e-mail whether the order has been accepted.

The purchase contract is formed only upon receipt by the User of the Service Provider’s separate e-mail confirming acceptance of the order.

The User is advised to verify both the order acknowledgement and the acceptance confirmation.

If either confirmation differs from the submitted order and the User does not object within twenty-four (24) hours of receipt, or if the User makes payment following receipt of the confirmation, the content of the confirmation shall prevail.

If a discrepancy is reported, the Service Provider shall investigate and, where appropriate, correct the order.

C)

Deletion of a User account after an order has been placed shall not affect the fulfilment of orders validly submitted before deletion.

D)

If the User requests deletion of personal data required for performance of the order or objects to its processing for such purpose, the Service Provider may request clarification regarding the User’s intention to withdraw from the order.

Modification of an Existing Order

A)

If the User wishes to modify an order already submitted or has provided incorrect information, the User must contact customer service as soon as possible.

Prompt notification is required to allow correction before fulfilment begins.

B)

Where an order is modified, the Service Provider shall issue a new confirmation reflecting the amended order details.

The contract shall be created or amended according to the revised confirmation.

General Payment Terms

A) General Payment Methods

Advance Payment by Bank Transfer

The User may select bank transfer as a payment method during checkout.

The bank details required to complete the transfer are provided in the order acknowledgement e-mail.

This payment method is available regardless of the selected delivery method.

Online Card Payment

The User may choose to pay through an online payment service provider during the checkout process.

Payment is made using a bank card.

Card details are provided directly and exclusively to the payment service provider because the User is redirected to the provider’s secure payment interface.

The payment service provider does not share card information with the Service Provider.

Additional terms governing online payments are set forth in the terms and conditions of the respective payment provider.

This payment method is available regardless of the selected delivery method.

B) Available Payment Methods by Market

Hungary

The following payment methods are currently available:

  • Shopify Payments

  • Revolut Pay

  • Bank Transfer

  • Cash Deposit at a Bank Branch

Online Payments

Online card payments and other electronic payment methods are processed through Shopify Payments.

Payment information entered during the transaction is not transmitted to the Service Provider and is processed exclusively by the payment provider in accordance with applicable security and data protection requirements.

Users may also complete payment through Revolut Pay.

Payment information required for processing the transaction is provided directly to Revolut and is handled in accordance with Revolut’s privacy and security policies.

For bank transfers, payment shall be made to the following account:

Please indicate the order number in the payment reference field.

Additional payment conditions are governed by the terms and conditions of the relevant payment service provider.

Cash Deposit at a Bank Branch

The User may choose payment by cash deposit during checkout.

The banking details required for the deposit are identical to those used for bank transfers and are included in the order confirmation.

The User may make a cash deposit at any OTP Bank branch or initiate a transfer through their own bank using cash payment.

Disclaimer of Liability

A)

The Service Provider is under no legal obligation to enter into a contract.

The Service Provider may freely decide whether to accept or reject any order.

The Service Provider shall not be liable for any damages resulting from rejection of an order.

B)

The Service Provider does not guarantee that any product or service is suitable for a specific purpose intended by the User.

Product descriptions and instructions are provided for informational purposes and shall govern the intended use of the products.

The Service Provider shall not be liable for deviations resulting from the User’s specific circumstances of use.

C)

The Service Provider shall not be liable for any direct or indirect damages resulting from misuse of the Website or from interruptions in internet service.

The Service Provider shall not be liable for technical failures including, but not limited to:

  • power outages;

  • computer network failures;

  • server outages;

  • internet connectivity disruptions.

Because the internet is an open network that cannot be considered fully secure, the Service Provider shall not be liable for damages resulting from loss, delay, destruction, or corruption of electronically transmitted messages or orders arising from causes beyond its control.

Miscellaneous Provisions

The Service Provider reserves all legal protections relating to the content of the Website and the rules governing its use, including with respect to Users who merely browse the Website without placing orders.

The parties agree to exercise their rights and fulfil their obligations under these Terms and Conditions in good faith and in a spirit of mutual cooperation.

Data Protection

Information regarding the processing of personal data by the Service Provider is contained in the documents entitled:

Amendment of the Terms and Conditions

The Service Provider reserves the right to amend these Terms and Conditions at any time without prior notice.

The version of the Terms and Conditions attached to the final order acceptance creating the contract shall govern the respective purchase agreement.

Complaints, Dispute Resolution and Supervisory Authorities

Complaints

Users may submit complaints to the Service Provider by mail, telephone, or e-mail using the contact details published on the Website.

Verbal complaints shall be investigated immediately and, where possible, resolved on the spot.

Written complaints and unresolved verbal complaints shall be answered in writing within thirty (30) days.

European Commission Online Dispute Resolution Platform

The European Commission provides an Online Dispute Resolution (ODR) platform for consumers who wish to submit complaints relating to products or services purchased online and seek assistance from an independent dispute resolution body.

Country-Specific Legal Remedies

Additional information regarding consumer protection authorities and legal remedies available in the User’s country of residence can be found in the country-specific versions of these Terms and Conditions.

Hungary

Consumers may submit complaints concerning product quality, product safety, services, or the conduct of the Service Provider, its employees, representatives, or persons acting on its behalf through the contact details published on the Website.

Consumers may also request the assistance of a Conciliation Board (Alternative Dispute Resolution Body) free of charge for disputes relating to product quality, product safety, contractual performance, and consumer rights.

The Service Provider shall cooperate in conciliation proceedings where required by law.

Nothing in these Terms and Conditions limits the User’s right to seek judicial remedies before the competent courts.
